CM Hire – Terms & Conditions

These Terms and Conditions form a legally binding agreement between you (“the Client”, “you”, “your”) and CM Hire (“we”, “us”, “our”).

By booking, hiring, purchasing, or using any product or service from CM Hire, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

1. Bookings & Payment (Hire Items)

Full payment is required at the time of booking to secure your hire item and selected dates.

All payments are strictly non-refundable.

Hire fees are charged per wear, per event.

It is the Client’s responsibility to:

  • Arrange a try-on where available;
  • Confirm correct sizing;
  • Request additional photos if required;
  • Ensure satisfaction with the garment’s condition prior to booking.

All bookings are final. Once confirmed:

  • Outfits cannot be swapped;
  • Hire dates cannot be changed;
  • Event dates cannot be transferred.

CM Hire reserves the right to refuse a booking at its discretion.

2. Hire Period & Returns

The hire period is agreed upon at the time of booking.

All hire items must be returned by the allocated date and time provided by CM Hire.

Late returns will incur a $10 AUD late fee per day until the item is returned.

If an item is not returned within 7 days of the due date and no communication has been made, CM Hire reserves the right to treat the item as lost and charge the full Recommended Retail Price (RRP).

Alternate return arrangements must be approved in writing prior to booking.

3. Condition of Garments

All garments are second-hand items and may show minor signs of general wear and tear.

By hiring, you acknowledge and accept the nature of second-hand garments.

Items must be returned in the same condition as received.

CM Hire reserves the right to assess garment condition upon return.

4. Damage Policy

Minor Damage - If a garment is returned with minor damage (including but not limited to small tears, missing buttons, broken zips, loose embellishments, or stains), the Client agrees to pay the repair costs as quoted by CM Hire’s nominated seamstress or dry cleaner. This cost is in addition to the hire fee.

Major Damage / Irreparable Damage - If a garment is deemed damaged beyond repair, the Client must pay the full RRP of the garment in addition to the hire fee.

Determination - CM Hire has sole discretion in determining whether damage is classified as minor or major.

Accidental damage does not exempt the Client from financial responsibility.

5. Cleaning

Clients must not:

  • Wash the garment;
  • Dry clean the garment;
  • Spot clean the garment;
  • Attempt to remove stains;
  • Iron or steam the garment (unless approved in writing).

Standard cleaning costs are included in the hire fee.

If a garment is returned with excessive staining, marks, spills, or odours requiring specialist or additional cleaning (including but not limited to fake tan transfer, makeup staining, wine stains, mud, or strong odours), additional cleaning costs will be charged to the Client.

6. Care of Garments

The Client agrees to:

  • Not alter the garment in any way;
  • Not pin, tape, or permanently modify the garment;
  • Not lend or sub-hire the garment;
  • Not use the garment in water-based activities or high-risk environments.

The garment remains the property of CM Hire at all times.

7. Postage (Hire Items)

Australia-wide express postage is available for $34 AUD (subject to change), covering both delivery and return postage.

Orders are dispatched 5 business days prior to your event.

Clients must ensure:

  • Correct delivery details are provided;
  • CM Hire is not responsible for:
  • Australia Post delays;
  • Lost or damaged parcels once lodged;
  • Late bookings made within 5 business days of the event;
  • Incorrect addresses provided by the Client.

No refunds will be issued due to the above circumstances.

Returns must:

  • Be lodged at an Australia Post counter (not in a street post box);
  • Be returned the next business day following your event;
  • Include tracking;
  • Have a photo of the lodgement receipt sent to CM Hire.

Late fees apply if not lodged on time.

8. Drop-Off Service

If drop-off delivery is selected, the garment will be delivered to the address provided.

If no one is present, the item may be left in a safe location at the property.

Once delivered, responsibility transfers to the Client.

CM Hire takes no responsibility for theft, loss, or damage after delivery.

If the item is stolen or lost after confirmed delivery, the Client must pay the full RRP.

9. Loss or Theft

If a hire item is lost, stolen, or not returned, the Client agrees to pay the full RRP in addition to the hire fee.

CM Hire reserves the right to pursue recovery of unpaid amounts.

10. COVID / Unforeseen Circumstances

If your event is cancelled due to:

  • Government lockdown,
  • Official public health order,

You may be eligible for a credit note valid for 6 months from the original hire date.

No refunds will be issued.

Credits are non-transferable and must be used by the original Client.

11. Credit Notes

Credit notes are issued at the sole discretion of CM Hire unless otherwise stated.

Credit notes:

  • Are valid for the specified time only;
  • Are non-refundable;
  • Cannot be exchanged for cash.

12. Sale Items

Full payment is required at the time of purchase. Orders will not be processed or dispatched until payment has been received in full.

All sales are final. No refunds, returns, exchanges, credits, or change-of-mind cancellations will be accepted.

Sale items are pre-owned, second-hand garments and may show signs of general wear and tear. By purchasing, the Customer acknowledges and accepts the condition of the item at the time of sale.

It is the Customer’s responsibility to:

  • Confirm correct sizing;
  • Request additional photos or information if required;
  • Ensure satisfaction with the garment’s condition prior to purchase.

Failure to do so does not entitle the Customer to a refund or exchange.

Postage costs are the responsibility of the Customer unless otherwise stated.

CM Hire is not responsible for:

  • Incorrect or incomplete delivery details provided by the Customer;
  • Delays caused by postal services;
  • Parcels lost, damaged, or delayed once lodged with Australia Post.

Risk and responsibility for the item transfers to the Customer upon confirmed delivery to the address provided.

Drop-off deliveries for sale items are subject to the same terms outlined in Section 8. Once the item has been delivered to the nominated address, CM Hire accepts no responsibility for theft, loss, or damage.

13. Limitation of Liability

CM Hire is not liable for:

  • Injury, loss, or damage arising from use of the garment;
  • Allergic reactions to fabrics;
  • Wardrobe malfunctions after the garment has been worn;
  • Event cancellations;
  • Indirect or consequential loss.

14. Amendments

CM Hire reserves the right to update these Terms and Conditions at any time. The version published on our website at the time of booking applies to your hire or purchase.

15. Payment Authorisation & Recovery of Costs

By entering into a hire agreement with CM Hire, the Client authorises CM Hire to charge the original payment method used at the time of booking for any outstanding amounts owed.

This includes, but is not limited to:

  • Late return fees;
  • Repair costs for damaged items;
  • Additional or specialist cleaning costs;
  • Replacement costs;
  • The full Recommended Retail Price (RRP) in the event of loss, theft, or irreparable damage.

The Client acknowledges that these charges may be processed without further notice where amounts are owing under these Terms and Conditions.

If the original payment method cannot be successfully charged, the Client agrees to pay all outstanding amounts within 7 days of receiving written notice from CM Hire.

If payment is not made within this timeframe, CM Hire reserves the right to pursue recovery of the debt, including referral to a debt collection agency. The Client may be liable for any reasonable recovery costs incurred.
